What is a domestic building dispute?
A domestic building dispute arises when there is disagreement between a homeowner and a builder or tradesperson about the quality, cost, or timing of residential construction work. These disputes are common in new builds, renovations, extensions, and repair works.
They often involve issues such as defective or substandard work, incomplete projects, construction delays, disputes over variations and costs, or breaches of statutory warranties under the Domestic Building Contracts Act 1995 (Vic). In some cases, disputes escalate to contract termination or insurance claims under Domestic Building Insurance.

A domestic building contract is an agreement to carry out, arrange, or manage domestic building work. It does not include contracts made between a builder and their subcontractors.
Example: If you sign a contract directly with a builder to construct your new home, that’s a domestic building contract. But if the builder then hires a plumber or electrician under a separate contract, that subcontract is not considered a domestic building contract.

Every domestic building contract in Victoria automatically includes statutory warranties. These warranties guarantee that building work is carried out properly, with suitable materials, and in line with building laws. If defects arise, you may be entitled to have the builder fix them or receive compensation for the cost of rectification. If the builder has disappeared, gone insolvent, or is otherwise unavailable, you may still be able to claim under Domestic Building Insurance (DBI).
Example: If your new home develops water leaks due to poor workmanship, the builder must return and fix the problem. If the builder cannot be found, you may instead be able to claim the cost of repairs through DBI.

Example: If a builder walks off-site and refuses to return, you may have grounds to terminate the contract. But, if you end the contract without following the correct legal process, the builder could turn around and claim you are in breach.
