When plumbing becomes a legal problem

Plumbing problems on site aren’t just inconvenient, they can derail entire projects. Faulty or unlawful work often leads to leaks, mould, water damage, or structural issues, leaving builders to deal with the consequences.

In Victoria, licensed plumbers must issue compliance certificates for most plumbing work valued over $750. These certificates are backed by mandatory insurance. If defects appear within 6 years, you may be able to claim directly against the plumber’s insurer to recover your losses.

Builders may face disputes when plumbers:

  • Deliver defective or non-compliant installations

  • Fail to issue or lodge compliance certificates

  • Cause damage to other trades’ work

  • Breach contract terms or act negligently

Knowing your rights and acting quickly is key to protecting your business.

Can you recover your losses?

In many cases, yes. If the work was performed or certified by a licensed plumber, and it has been less than six years since the compliance certificate was issued (or since the work was completed where no certificate exists), you may be able to recover rectification costs and damages through the plumber’s insurer.

This can include costs to fix defective plumbing, compensation for delays, or even damage caused to other trades’ work. Importantly, claims can often succeed even if the plumber is insolvent, has disappeared, or refuses to cooperate.

Seeking legal advice early helps preserve evidence, clarify your position, and improve your chances of success..

FAQ

  • Yes, you are able and should claim your legal fees and expert report costs in your claim.

  • If you discover that plumbing work is defective or non-compliant, you should immediately document the issue with photographs, detailed notes, and any relevant communications. You should also check whether the plumber issued a compliance certificate. We recommend seeking legal advice before engaging in rectification or making a formal complaint.

  • Yes, as the principal builder, you may be liable to the building owner or developer if the plumbing work fails, even when it was subcontracted. This is why it is critical to ensure that your subcontractors are licensed, compliant, and adequately insured. If the plumber’s work is defective, you may have legal options to pursue them for indemnity or contribution.

  • A plumbing compliance certificate is a document issued by a licensed plumber confirming that the work complies with relevant laws, standards and regulations. It is legally required for most plumbing work valued over $750. The certificate triggers an insurance policy that may allow you, as the builder, to make a claim if the work is defective and the plumber cannot or will not rectify the problem.

  • Yes, if you have discovered the defective work within 6 years.

It is also not necessary to wait for the plumber to be dead, missing or bankrupt to access the insurance.

We can assist you in preparing and lodging such claims.

  • The process usually involves:

    1. Gathering documentation, including the compliance certificate, evidence of the defective work, expert reports, and correspondence

    1. Notifying the insurer within 6 years of the compliance certificate, or if a certificate was not issued, 6 years from when the work was completed

    1. Submitting a formal claim including the nature of the defect, cost of rectification, and supporting evidence

    1. Responding to any requests for additional information

We guide builders through each stage and deal with the insurer on your behalf.

  • Yes, particularly if the plumber is uncooperative, unlicensed, or has failed to rectify the defective work. The BPC regulates plumbers in Victoria and can investigate complaints, issue orders, or take disciplinary action. A BPC complaint may also support your insurance or legal claim.

  • Yes, in many cases builders who have paid for rectification work may be able to recover those costs from the responsible plumber or their insurer, provided you have sufficient evidence. This includes invoices, reports, photographs, and correspondence showing your attempts to resolve the issue before taking action.

  • Disputes over responsibility are common in construction projects. In such cases, expert evidence is often needed to determine whether the work met standards. We can assist in obtaining independent expert reports and provide advice on how to respond to the plumber’s position.

  • Yes. We regularly represent builders at VCAT and court in disputes involving plumbing defects, subcontractor liability, and insurance claims. We also assist with compulsory conferences and settlement negotiations to resolve the matter efficiently.

  • You should seek legal advice as soon as:

    • You identify defective plumbing work

    • You receive a complaint from a building owner

    • You are required to pay for rectification

    • The plumber refuses to take responsibility

    • You are considering a VBA complaint or insurance claim

Early legal intervention can help protect your commercial interests, reduce project delays, and limit your liability.
