Compliance certificates & why they matter

In Victoria, licensed plumbers must issue a compliance certificate for certain types of plumbing work, including:

  • Jobs valued at $750 or more (including labour, materials, or appliances)

  • Work on below-ground sanitary drains

  • Installation, replacement, or relocation of gas appliances or gas piping

  • Installation or modification of cooling towers

Plumbers are legally required to give you a signed certificate within 5 days of completing the work and notify the Victorian Building Authority (VBA). Failure to do so is an offence.

Why this matters: compliance certificates link the plumbing work to the plumber’s insurance. If defects are discovered later, these certificates allow you to access the plumber’s insurer (through a freedom of information process) and make a claim. Without them, recovering compensation becomes more difficult..

  • A compliance certificate is a legal document issued by a licensed plumber in Victoria to confirm that plumbing work complies with the relevant laws, regulations, and standards. It is required for most plumbing work valued at $750 or more. The certificate also triggers an insurance policy that protects the building owner or builder if the work is later found to be defective and the plumber is no longer available or refuses to take responsibility.

  • Yes.  It does not matter if the plumber is missing or bankrupt, you can make a claim regardless. 

    In certain situations, you have greater entitlements to make a claim when the plumber is: 

    • Dead 

    • Legally incapacitated 

    • Disappeared 

    • Insolvent 

    • Now unlicenced or suspended 

    • The plumber refused to make a claim

  • If the plumbing work was required to have a compliance certificate, the plumber should have provided one to you and lodged a copy with the Building and Plumbing Commission (formerly VBA). If you do not hold the certificate, you may be able to obtain a copy from the BPC. We can assist with locating the certificate and assessing your eligibility to claim. 

  • An expert report is often critical in proving that plumbing work was defective and quantifying the cost of rectification. We work with qualified building consultants and plumbing experts who can prepare detailed reports to support your claim. This evidence is especially important when pursuing an insurance claim or lodging a VCAT application. 

  • Time limits do apply. In most cases, you must bring a claim within six years of the date of the compliance certificate, or if a compliance certificate was never issued, 6 years after the defective work was completed. It is important to seek legal advice as soon as you become aware of the issue to avoid missing important deadlines. 

  • Keep a written record of your communications with the plumber, including emails, texts and letters. Take photographs of the defective work or damage and retain any invoices, reports or permits. Then contact us for legal advice. We can send a formal letter of demand, assist with lodging a complaint or claim, negotiate with the insurers, and represent you if the matter proceeds to VCAT or court.
